We consider the creation of accounts with intentionally false, nonsensical, or disposable information (such as using "hhh hhh" as a name or a temporary email address) to be a form of abuse and a breach of these Terms.
An account is intended for use by a single, named individual. Sharing your account credentials with any other person is a breach of these Terms and may result in the suspension of your access to our paid Services.
You agree not to create multiple accounts for the purpose of circumventing our Terms, abusing promotional offers, or evading a prior account termination.
We reserve the right to suspend or terminate any account that we determine, in our sole discretion, is in violation of these responsibilities.
Section 2 – General Conditions
We reserve the right to refuse Service to anyone at any time, for any reason, in our sole discretion. You acknowledge that your content (excluding sensitive payment data) may be transmitted over unencrypted networks and that we are not responsible for any interception or unauthorized access. You agree not to reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Service without our express written permission. The headings in these Terms are provided solely for convenience and do not affect interpretation.

Superellipse_ offers digital products in two forms: one-time Digital Asset purchases and Memberships (subscriptions) that grant recurring, unlimited download access to our downloadable CGI assets. One-time purchases are delivered immediately upon payment; Memberships provide ongoing access until canceled as described in our Cancellation Policy. All products are digital and provided “as is” without any warranty regarding their fitness for your intended purpose. We are not responsible for any disruptions or issues arising from your use of our assets.
Section 6 – Accuracy of Billing and Account Information
You agree to provide current, complete, and accurate information when placing orders or registering an account on our Site. It is your responsibility to update your account details as needed. We reserve the right to cancel or limit orders if the information provided is inaccurate or fraudulent. In such cases, any fees paid will be handled in accordance with our Refund Policy.
Section 7 – Optional Tools and Third-Party Integrations
From time to time, we may provide access to third-party tools and integrations (such as analytics or marketing applications) to enhance the Service. These tools are provided “as is” without any warranties, and their use is at your own risk. By providing submissions to our Site or directly to us via email or social media—such as comments, reviews, testimonials, images, or videos (“Submissions”)—you grant Superellipse_ permission to feature, share, reproduce, and distribute your Submissions for marketing and promotional purposes in connection with our Service. This includes, but is not limited to, featuring your Submissions on our website, in our social media channels, and in other marketing materials.
You acknowledge that we have no obligation to provide compensation for such Submissions. Where feasible, we will make a reasonable effort to provide attribution by crediting your name or social media handle.
For clarity, this permission applies only to the content you voluntarily provide as a Submission. It does not grant us any ownership of your Submissions or any license to your independent creative projects beyond what you have shared with us.

In no event shall Superellipse_, its directors, officers, employees, affiliates, agents, or contractors be liable for any direct, indirect, incidental, or consequential damages—including lost work, financial losses, or disruptions to your projects—resulting from your use of the Service, to the maximum extent permitted by applicable law.
Section 14 – License and Use of Digital Assets
Upon purchase of a Digital Asset or a Membership, you are granted a limited, non-exclusive, non-transferable license to use our Digital Assets solely as an integral part of your creative projects (“Customer Assets”). This license applies to both one-time purchases and downloads under Memberships.
You agree that you may not, without our express written consent:
– Resell, redistribute, or otherwise make the Digital Assets available as standalone files;
– Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying structure of the Digital Assets;
– Repackage, modify, or create derivative works based solely on the Digital Assets in a manner that competes with our Service;
– Use the Digital Assets for any unauthorized purpose, including training or enhancing generative AI models, unless explicitly permitted in writing;
– Permit any third party to access, download, or extract the Digital Assets outside of your own creative projects.
All intellectual property rights in the Digital Assets remain with Superellipse_. Our assets are licensed—not sold—and this license expressly prohibits their use in a manner that competes with Superellipse_ or allows third parties to obtain the Digital Assets as standalone products.
Section 15 – Fair Use Policy and Download Limits
Our "Unlimited" & "Pro" Membership plans are designed to provide creative freedom for active projects, not to facilitate the creation of offline databases or personal mirrors of our Service. We employ automated monitoring systems to detect excessive downloading patterns, bot activity, and account sharing.
To ensure the stability of the Service for all users, we reserve the right to:

Require Security Verification: Mandate Captcha or other security checks if your download volume triggers our safety flags;

Throttle Access: Temporarily restrict download speeds or access for accounts exhibiting unusual velocity;

Terminate Accounts: Suspend or permanently revoke access for accounts found to be in violation of our Fair Use Policy, without refund.
You acknowledge that "Unlimited" access is subject to this Fair Use Policy and that we may update the thresholds for abuse detection at our sole discretion.
Section 16 – Team Memberships and Account Management
If you purchase a team Membership, your account will be administered by a designated Team Administrator. The Team Administrator is solely responsible for managing access to the team account, including adding or removing team members. You acknowledge that it is the Team Administrator’s responsibility to ensure that only authorized individuals have access, and Superellipse_ is not liable for any disputes or unauthorized changes resulting from the Team Administrator’s actions. Additionally, you are responsible for canceling your membership before the next billing cycle to avoid further charges.
Section 17 – Indemnification
You agree to indemnify, defend, and hold harmless Superellipse_, its affiliates, directors, officers, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of our Service or breach of these Terms. This obligation shall survive termination of your access to the Service.
Section 18 – Confidentiality
From time to time, Superellipse_ may provide you with information that is clearly designated as “Confidential.” You agree not to disclose this Confidential Information to any third party without our prior written consent.
This general clause is not intended to govern the protection of your personal data, which is detailed in our Privacy Policy. Furthermore, this clause does not supersede any specific Non-Disclosure Agreement (NDA) or other formal written contract executed between you and Superellipse_.
Section 19 – Assignment and No Partnership
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. Any unauthorized assignment is null and void. Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Superellipse_.
Section 20 – Termination
You may terminate these Terms at any time by ceasing to use our Service. We reserve the right to suspend or terminate your access immediately, without prior notice, if you breach any of these Terms. Termination does not affect any rights or obligations accrued prior to termination. Additionally, if you fail to cancel your Membership before the start of the next billing cycle, you will be charged for the new period.
Section 21 – Dispute Resolution and Governing Law
Any dispute or claim arising out of or relating to these Terms shall be resolved in accordance with the laws of the United Kingdom. The parties agree to first attempt to resolve disputes through negotiation. If unresolved, disputes may be submitted to binding arbitration or brought before the courts located in the United Kingdom, which shall have exclusive jurisdiction.
Section 22 – Entire Agreement
These Terms, together with our Refund Policy, Cancellation Policy, Privacy Policy, and any other documents incorporated by reference, constitute the entire agreement between you and Superellipse_ regarding your use of the Service. They supersede all prior or contemporaneous agreements, whether oral or written.
Section 23 – Changes to Terms of Service
We reserve the right to modify these Terms at any time by posting updates on our Site. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
